Introduction; Effective Date
Welcome to Unified Mind. These Terms and Conditions (“Terms”) govern your purchase, use, and acceptance of the services provided and available at Unified Mind. Please read these Terms carefully before purchasing, accessing, or receiving Unified Mind services. These Terms are applicable upon any purchase of the services offered by Unified Mind, or upon registration for services offered by Unified Mind, whichever occurs first.
Consent and Capacity
Your use of our services is conditioned on your acceptance of these Terms. If you do not agree with these Terms, please do not accept or purchase services offered or available from Unified Mind. By using or purchasing our services, you warrant that you are entering into a binding contract with Unified Mind. Any additional terms are not intended to replace or supersede these Terms, but rather supplement these Terms in those specific areas.
Education and Information; Not Medical Advice
Unified Mind’s services are provided for educational and informational purposes, and the services available from Unified Mind are not intended as a substitute for professional medical advice, diagnosis, or treatment. Unified Mind services shall not be construed as medical advice, and the services are tailored to education and self-improvement purposes. By accepting services from Unified Mind you acknowledge that the service offerings of Unified Mind are complementary to, and not a substitute for, treatment from a healthcare professional. We encourage you to seek medical advice whenever necessary. Unified Mind does not guarantee any particular result as a result of your receiving services, and individual results may vary.
You understand and agree that the services provided by Unified Mind are not intended to, designed, or implied to: (i) diagnose, prevent, or treat any condition or disease; (ii) to ascertain the state of your health, to be a substitute for professional medical care; (iii) to be a substitute for the advice of a financial advisor, certified nutritionist, or medical professional. No information provided as part of the Coaching Services is intended to substitute for professional medical advice, diagnosis, or treatment. You understand and agree that you are solely responsible for your participation in any services of Unified Mind, including any decisions you make based on information obtained therefrom. If you need medical attention, always seek the advice of your physician or another qualified healthcare provider. Never disregard professional medical advice or delay medical treatment because of information received through the Unified Mind services. Further, no information provided as part of the services should be construed as investment, legal or tax advice. Not all activities described on the services or products and not all coaching services are suitable for everyone. If necessary, you should consult with your physician before beginning participating in any services that require any physical movement or exertion to ensure you are medically fit to participate.
Client Responsibilities
You agree to provide complete and accurate information about relevant medical history, current medications, and any relevant health conditions that may impact your ability to accept any service offerings of Unified Mind. You agree to understand the limitations of our services and participate voluntarily, and you have the right to ask questions and decline any service at any time. Therapy of any kind is a collaborative process. As such, you agree to actively participate to the extent necessary to receive the benefit of the services you have selected. You are solely responsible for your own well-being and choices. Unified Mind encourages you to practice self-care and make healthy lifestyle decisions.
Purchases and Fees
Unified Mind may offer for purchase access to certain features of the services on a time limited basis (a “Subscription”), including coaching or other service offerings on a one-off basis (“Products”). A description of the features associated with Subscriptions and Products is available on the Unified Mind website. When you purchase a Subscription or Product (each, a “Transaction”), Unified Mind may ask you to supply additional information relevant to your Transaction, such as credit card information or other payment information to ensure payment is capable of receipt by Unified Mind (“Payment Information”). You represent and warrant that you have the legal right to use all payment methods represented by any Payment Information. The amounts due and payable by you for a Transaction through the services of Unified Mind will be presented to you before you place an order. If you choose to initiate a Transaction via the services, you authorize us to provide your Payment Information to a third party service provider so that we can process your Transaction and (i) agree to pay the applicable fees; (ii) that Unified Mind may charge your credit card or payment mechanism for pre-authorization and payment purposes. All payments made are non-refundable and Subscriptions and Products are non-transferable.
Unified Mind reserves the right to not process or cancel your order in its sole discretion, including, for example, if your credit card is declined, if we suspect the request or order is fraudulent, or in other circumstances Unified Mind deems appropriate in its sole discretion. Unified Mind also reserves the right, in its sole discretion, to take steps to verify your identity in order to verify your relationship and connection with your order(s). Unified Mind will not charge you for orders that we do not process and will refund you for orders that are cancelled.
Classes; Sessions
When you access any Unified Mind services, you understand and agree that you are responsible for entering the session at the set start time and that you will forfeit (and will not be eligible for a refund) any payment or purchases for a scheduled session that you do not attend or enter late. You further agree that you will behave in a professional and courteous manner, that you will not harass or intimidate individuals providing the services, and that you will otherwise behave in accordance with these Terms. You acknowledge and agree that if you do not behave in accordance with the foregoing, your ability to access or use Unified Mind services may be terminated.
Confidentiality
Unified Mind respects your privacy and confidentiality. All information shared, exchanged, provided, or otherwise learned of in the course of Unified Mind’s provision of services will be kept strictly confidential, except where required by law. Unified Mind is committed to maintaining the confidentiality of all client information, and we employ the necessary safeguards to ensure your information is protected from unauthorized access, disclosure, or misuse. Confidential Information will only be used to perform and improve the services you receive.
No Warranty; Disclaimers
THE SERVICES, PRODUCTS AND CONTENT ARE PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND. WITHOUT LIMITING THE FOREGOING, UNIFIED MIND EXPLICITLY DISCLAIMS ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE. UNIFIED MIND MAKES NO WARRANTY THAT THE SERVICES, PRODUCTS, OR CONTENT WILL MEET YOUR REQUIREMENTS OR BE AVAILABLE ON AN UNINTERRUPTED OR ERROR-FREE BASIS. UNIFIED MIND MAKES NO WARRANTY REGARDING THE QUALITY, ACCURACY, TIMELINESS, TRUTHFULNESS, COMPLETENESS, OR RELIABILITY OF ANY SERVICES, PRODUCTS OR CONTENT.
YOU ACKNOWLEDGE AND AGREE THAT UNIFIED MIND AND ITS REPRESENTATIVES, INCLUDING ANY PROVIDERS OF SERVICES, ARE NOT NUTRITIONISTS, MEDICAL PROFESSIONALS, PSYCHOLOGISTS, PSYCHIATRISTS, PSYCHOTHERAPISTS STOCKBROKERS, FINANCIAL ADVISORS, FIDUCIARIES OR CERTIFIED PUBLIC ACCOUNTANTS, AND UNIFIED MIND DISCLAIMS ALL LIABILITY FOR ANY INJURY SUSTAINED OR ANY CHOICES OR DECISIONS YOU MAKE RESULTING FROM YOUR PARTICIPATION IN OR RECEIVING UNIFIED MIND SERVICES. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED FROM A SERVICE PROVIDER OF UNIFIED MIND IN THE COURSE OF THE SERVICES, INCLUDING ANY COACHING SERVICES IS INTENDED TO SUBSTITUTE FOR PROFESSIONAL MEDICAL ADVICE, DIAGNOSIS OR TREATMENT OR WILL CREATE ANY WARRANTY NOT EXPRESSLY MADE HEREIN AND UNIFIED MIND BEARS NO RESPONSIBILITY OR LIABILITY FOR UNDESIRABLE OUTCOMES. ANY ACTIONS YOU TAKE BASED ON YOUR INTERPRETATION OF THE INFORMATION PROVIDED ON THE SERVICES OR IN ANY SERVICES ARE YOURS ALONE. UNIFIED MIND HEREBY DISCLAIMS ALL LIABILITY FOR, AND YOU WILL NOT HOLD UNIFIED MIND, ITS AFFILIATES OR ANY THIRD-PARTY SERVICE PROVIDER LIABLE FOR ANY POSSIBLE CLAIM FOR DAMAGES ARISING FROM ANY DECISION YOU MAKE OR MADE BASED ON INFORMATION RECEIVED THROUGH YOUR RECEIVING SERVICES FROM UNIFIED MIND.
Indemnity
You agree to indemnify and hold harmless Unified Mind and its officers, directors, employees, advisors, and agents from and against any claims, disputes, demands, liabilities, damages, losses, and costs and expenses, including, without limitation, reasonable legal and accounting fees arising out of or in any way connected with (i) your access or use of the services; or (ii) your violation of these Terms.
Limitation of Liability
NEITHER UNIFIED MIND NOR ANY OTHER INVOLVED IN CREATING, PRODUCING, OR DELIVERING THE SERVICES OR PRODUCTS OR CONTENT, INCLUDING ANY COACHING SERVICES OR HYPNOSIS THERAPY SERVICES, WILL BE LIABLE FOR ANY INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES, INCLUDING, BUT NOT LIMITED TO, LOST PROFITS, LOSS OF DATA OR GOODWILL, SERVICE INTERRUPTION, THE COST OF SUBSTITUTE SERVICES OR PRODUCTS ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR FROM THE USE OR INABILITY TO USE THE SERVICES, PRODUCTS, OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), PRODUCT LIABILITY OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT UNIFIED MIND HAS BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE, EVEN IF A LIMITED REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE.
IN NO EVENT WILL UNIFIED MIND’S TOTAL LIABILITY ARISING OUT OF OR IN CONNECTION WITH THESE TERMS EXCEED THE AMOUNT YOU HAVE PAID UNIFIED MIND IN THE PREVIOUS ONE (1) MONTH IMMEDIATELY PRIOR TO CAUSE OF ACTION GIVING RISE TO SUCH CLAIM. THIS LIMITATION OF LIABILITY IS A FUNDAMENTAL ELEMENT OF THE BASIS OF THE BARGAIN BETWEEN YOU AND UNIFIED MIND.
Governing Law
These Terms and any action related thereto are governed by the laws of the State of Minnesota without regard to its conflict of laws provisions.
Dispute Resolution; Arbitration
You and Unified Mind agree that any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof or the use of the services or products will be settled by binding arbitration. The arbitration will be administered by the American Arbitration Association (“AAA”) in accordance with the Commercial Arbitration Rules and the Supplementary Procedures for Consumer Related Disputes (“AAA Rules”) then in effect. Arbitration shall be held in Goodhue County, Minnesota. Unified Mind shall select a single arbitrator to conduct the arbitration, and the parties to the arbitration shall equally split the cost of such arbitration. The arbitrator’s decision shall be binding and final. Judgment on the arbitration may be entered in any court having jurisdiction thereof. The arbitrator may award declaratory or injunctive relief only in favor of the claimant and only to the extent necessary to provide relief warranted by the claimant’s individual claim.

Refund Policy
The return on this investment can be staggering but only if you finish what you start, so there will be no refunds given. The Learn 2 Find Love program is about creating a committed relationship. To yourself and eventually to your lifelong romantic partner. Our intention is that you remain committed to this course in order to derive the benefits enjoyed by so many of our graduates.
In the case of a catastrophic emergency a student may contact us to request a temporary suspension of their registration. This may be redeemed (but is not transferrable to another person) for a future class.
Privacy Policy
We understand your privacy is very important to you. We will never share your email address or contact information of any kind with any outside organization. We only use secure servers and never share your financial information with anyone.
We also require that our students respect each other’s privacy and do NOT discuss students’ shared information outside of class. If anybody is found in violation of this or is behaving in a rude or unacceptable manner, then they will be asked to leave the course and no refund will be given. Keeping a safe and supportive environment for our Webinar group is one of our top goals.
L2FL Additional Terms
The Learn 2 Find Love (L2FL) course participant agrees not to share any course material with anyone who is not currently registered in or has completed a L2FL program. Dawn Bennett may use at her discretion all information and materials gathered from past and current course participants in current and future works, communications and publications both online and offline while protecting the privacy of its course students and graduates, i.e. using aliases only unless the graduate gives their express permission to do otherwise.
The L2FL course does not guarantee (it would be illegal to do so) that a course participant will find their mate. Dawn Bennett, BodyKneads Massage,LLC , its partners, its instructors, independent contractors and support staff are not responsible for any outcome, positive or negative that a course participant experiences. Course participants are entirely responsible for their own experience in any of the L2FL courses and in applying the tools and techniques taught in the course after the classes are complete. The L2FL course is not a substitute for therapy.
If the class instructor is unable to teach in the case of a personal or health emergency, ‘act of God’, technical difficulties or other conditions outside of the instructor’s control, then the course will be rescheduled. If, due to any of the aforementioned conditions the entire course is cancelled then all tuition monies will be fully refunded.
Dawn Bennett and Unified Mind reserves the right, at its discretion, to change, modify, add, or remove portions of these Terms at any time. Notification of changes to these Terms will be posted on the website.
Recordings
All classes are recorded and posted online for those who have purchased the L2FL class or associated programs. You agree to be recorded (should you choose to say anything or show your camera) and for the videos to be posted.
